application but such a decision must be consistent with the Rules and with Statute. Such a decision must be explained to the individual in writing, together with their rights of appeal.
4.4 All members must comply with the rules both of the Branch and of the National Rules
4.5 All members of the Branch have a duty to follow the rules of the Union. Disciplinary action may be taken against any member in accordance with the National Rules. For the purposes of considering disciplinary charges there shall be a Disciplinary Sub Committee of the Branch Committee.
4.6 The NEC may terminate an individual's membership in accordance with the Rules.

BRANCH STRUCTURE
5. 1 The Branch shall establish a Branch Executive Committee which shall consist of:

  • two or more stewards from each Department of the East Lothian Council, as approved by the Branch meeting taking into account the size of the membership in that work group.
  • such representatives of self-organised groups and/or voluntary groups within the Branch as the Branch may determine.
  • the Branch Chairperson, Secretary, Treasurer, Equality officer(s) and Health and Safety Officer and other officers elected in accordance with the Union's Rules.
5.2 Each Department shall be divided into constituencies each with their own steward, the constituencies to reflect the structures of management within each department Stewards shall be elected by and from the work group that they represent. Elections shall take place annually, in the month preceding the AGM. Each Department shall at least seven days prior to the AGM forward to the Branch Secretary the names of the stewards appointed. In the event of any vacancy in departmental representation arising during the year the Executive Committee shall be empowered to fill the vacancy by appointment or by election within the relevant workplace.
5.3 In each department a UNISON Committee shall be established consisting of all Stewards from that department. The Committee shall elect from its body a Lead Steward and a deputy lead steward who shall act as lead negotiators within the department and shall co-ordinate the activities of the union within that area. The Lead Steward and the deputy Lead Steward shall also represent the department on the Branch Executive Committee, along with other stewards where appropiate. Other members of the Committee shall adopt roles which reflect those services provided by Branch Officers (e.g. Education and Health & Safety). Departmental Committees may, set up functional groups to reflect the divisions in the department or particular occupational groups (e.g. Housing & Social Work).
5.4 Regular Departmental Committee meetings shall take place regularly and at least six times in any one year.  Minutes and agendas shall be issued in advance to a Committee members. The Committee shall consider:
  • motions submitted for the agenda and may act on such motions or process them to the Branch Committee as appropriate.
  • items remitted from the Branch Committee and furnish comments as appropriate.
  • matters arising from discussions/negotiations with management or arising from Committee reports.
  • Conditions of Service matters relating to the departmental membership.
  • any other competent business.
