EAST LOTHIAN COUNCIL PROCEDURE FOR MANAGING SICKNESS ABSENCE (Covering all Staff excluding Teachers) 1. INTRODUCTION 1.1 This procedure is designed to assist Directors/Heads of Service in the management of sickness absence. It is intended that the provision of the procedure will be implemented in a reasonable and even handed manner with a view to establishing a consistent approach across the Council. 1.2 Whilst it is intended to establish consistency it is acknowledged that each situation must be considered reasonably and in light of the particular circumstances of the case. 1.3 It is recognised that Directors/Heads of Service and Line Managers have a crucial role in the operation of this procedure. To enable them to fulfil the role the Council will provide appropriate training in the operation of the procedure and associated matters. In addition, support, advice and guidance will be available from the Personnel Division to Directors/Heads of Service and Line Managers. Employees of the Council who are members of Trade Unions may wish to seek advice from relevant Shop Stewards/Local Representatives on the application of this procedure. 1.4 Whilst the management of sickness absence is primarily a line management responsibility, the Personnel Division shall be closely involved in the operation of the Procedure. In particular the Head of Personnel shall be responsible for providing written information, including the obtaining of occupational medical reports and other confidential details. All such information shall be retained only on individual employees files. 1.5 The operation of this procedure often involves the use of sensitive and personal information. All employees of the Council are reminded that such information must be treated as confidential and that any inappropriate disclosure of such information may be considered a disciplinary offence. 1.6 It is recognised that there are circumstances where it would be inappropriate for an employee's immediate Line Manager to operate the procedure. In these circumstances a more Senior Officer of the Council shall undertake the responsibility. . 1.7 Directors/Heads of Service shall, following consultations with the Head of Personnel, nominate those Line Managers (by post designation) who have delegated responsibility to operate this procedure. The Head of Personnel shall ensure that appropriate training is given to Line Managers who are nominated to operate this procedure. 2. DISABIILITY DISCRIMINATION ACT 1995 2.1 In the operation of this procedure particular regard will be given to the provisions of the Disability Discrimination Act 1995, which indicates that it is unlawful for an employer to discriminate against an employee on grounds of disability.
